By accessing or using our website, submitting an online form, or otherwise interacting with our online services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use our website or online services.

Helm Exteriors is a Texas exterior contracting company specializing primarily in residential and commercial roofing services, along with gutters and selected architectural exterior services. Our guiding standard is Built on Honor. Finished with Excellence.

Website information is intended to provide general information about Helm Exteriors, our values, and the services we may offer. Availability, scope, pricing, materials, scheduling, warranty eligibility, and service areas are subject to confirmation.

Eligibility

You must be at least 18 years old and legally capable of entering into a binding agreement to use our website to request services, approve work, submit project information, or enroll in a communication program.

If you use the website on behalf of a company, property owner, association, trust, or other legal entity, you represent that you have authority to act for and bind that entity.

Website Use Does Not Create a Construction Contract

Using our website, contacting Helm Exteriors, requesting an inspection, or receiving preliminary information does not create:

  • A construction contract
  • A contractor-client relationship
  • A warranty
  • A duty to perform work
  • A public adjuster relationship
  • An attorney-client relationship
  • An insurance-advisory relationship
  • A fiduciary relationship
  • A guarantee that Helm Exteriors will accept or complete a project

A binding agreement for roofing, repairs, replacement, gutters, siding, warranties, or other services exists only after the parties execute a separate written contract, proposal, work authorization, warranty agreement, or other document expressly accepted by Helm Exteriors.

If these Terms conflict with a signed project agreement, the signed project agreement controls with respect to that project.

Inspections & Estimates

A. Inspection Limitations

Roof and exterior inspections are based on conditions reasonably observable at the time of inspection. Conditions may be concealed by roofing materials, insulation, walls, decking, coatings, vegetation, weather, restricted access, unsafe conditions, or other obstacles.

Unless expressly stated in a signed agreement, an inspection is not:

  • An engineering analysis
  • A building-code certification
  • An environmental assessment
  • A mold or hazardous-material inspection
  • A structural certification
  • A guarantee that every defect has been identified
  • A determination of insurance coverage
  • A guarantee of remaining roof life

Helm Exteriors may decline to access an area or perform an activity that we reasonably believe is unsafe, inaccessible, unlawful, destructive, or beyond the agreed scope.

B. Estimates

Website pricing, examples, calculators, promotions, and general statements are informational only and are not binding estimates or offers. An estimate may change based on actual measurements, material prices and availability, permit or code requirements, hidden or unforeseen conditions, decking or structural conditions, product selections, scope changes, access limitations, labor or delivery conditions, weather, manufacturer requirements, and other project-specific factors.

Only a written proposal or contract issued or approved by Helm Exteriors may establish project pricing.

C. Free Inspections

A "free inspection" generally refers to the initial visual assessment identified in the applicable offer. It does not automatically include destructive testing, engineering, laboratory testing, emergency mitigation, detailed estimating, specialized reports, permit fees, or services outside the described offer. Helm Exteriors may modify or discontinue promotional inspection offers at any time, subject to applicable law and any existing written agreement.

Insurance & Storm-Damage Matters

Helm Exteriors may inspect storm-related property conditions, prepare construction estimates, take measurements or photographs, recommend repair methods, and provide factual information concerning materials, labor, scope, and completed work.

However:

  • Helm Exteriors is not your insurance company
  • Helm Exteriors does not determine whether a loss is covered
  • Helm Exteriors does not guarantee that a claim will be opened, approved, supplemented, or paid
  • Helm Exteriors does not interpret insurance policies
  • Helm Exteriors does not provide legal advice
  • Helm Exteriors does not negotiate an insurance settlement on your behalf
  • Helm Exteriors does not act as a public insurance adjuster for property on which it is providing or may provide contracting services

You are responsible for communicating with your insurer, understanding your policy, complying with deadlines, choosing whether to file a claim, and deciding whether to retain an attorney, licensed public adjuster, engineer, accountant, or other independent professional.

At your request, Helm Exteriors may provide factual construction documents, estimates, invoices, photographs, product information, measurements, or repair information to you or an authorized insurance representative. Providing such information does not make Helm Exteriors your representative in negotiating or settling a claim.

Helm Exteriors is not affiliated with or endorsed by any insurance carrier, governmental agency, emergency-management organization, or public adjuster unless expressly stated in writing.

Emergency & Temporary Services

Submitting a website form, voicemail, email, chat message, or text message does not guarantee an immediate response or emergency service.

If you believe a condition presents an immediate threat to life, health, fire safety, structural stability, or electrical safety, contact emergency services or the appropriate qualified professional.

You remain responsible for taking reasonable steps to protect people and property from further damage until a separate written agreement for emergency or temporary services has been accepted by Helm Exteriors.

Scheduling & Weather

Inspection dates, installation dates, delivery dates, and project timelines are estimates unless expressly guaranteed in a signed agreement. Roofing and exterior work may be affected by:

  • Rain, hail, wind, heat, lightning, or other weather
  • Wet or unsafe surfaces
  • Material shortages or delivery delays
  • Permit or inspection delays
  • Crew, equipment, or supplier availability
  • Hidden conditions
  • Changes requested by the customer
  • Utility or access issues
  • Events outside Helm Exteriors' reasonable control

Helm Exteriors may reschedule activities when reasonably necessary for safety, quality, legal compliance, or proper installation.

Products, Colors & Samples

Photographs, digital renderings, website graphics, and product images may not perfectly represent actual color, texture, profile, finish, weathering, scale, or appearance. Physical products may vary due to manufacturing tolerances, lot differences, lighting, display settings, natural materials, installation patterns, and environmental conditions.

Final product choices should be confirmed through the applicable proposal, product documentation, and available physical samples.

Warranties

Website statements do not create an express or implied warranty. Any workmanship warranty, manufacturer warranty, extended warranty, roof-maintenance plan, or realtor warranty program is governed exclusively by its separate written terms, eligibility requirements, exclusions, registration procedures, maintenance requirements, transfer rules, and claim procedures.

Warranty availability may depend on:

  • Full and timely payment
  • Proper maintenance
  • Product registration
  • Authorized installation
  • Scope of work
  • Existing conditions
  • Customer compliance
  • Manufacturer requirements
  • Other conditions stated in the applicable warranty

No employee, salesperson, subcontractor, website statement, social-media post, or oral statement may modify a written warranty unless the modification is made in writing by an authorized representative of Helm Exteriors.

Communications & Electronic Consent

A. Electronic Communications

By contacting Helm Exteriors electronically, you consent to receive documents and communications electronically where legally permitted, including appointment confirmations, estimates and proposals, contracts and change orders, invoices and receipts, project updates, warranty documents, service reminders, email correspondence, and other notices concerning your inquiry or project.

You are responsible for providing accurate contact information and notifying us of changes.

B. Telephone Calls & Emails

By submitting a request for contact, you authorize Helm Exteriors to contact you at the telephone number or email address you provide regarding your inquiry, subject to applicable law and the choices presented at the time of submission.

Marketing emails will include an opt-out method where required. Unsubscribing from marketing communications will not prevent necessary transaction, appointment, project, billing, safety, or warranty communications.

SMS & MMS Terms

These SMS and MMS terms apply when you separately consent to receive text messages from Helm Exteriors.

A. Program Description

Text messages may include inspection or appointment reminders, estimate follow-ups, scheduling information, project updates, weather-related updates, document or payment reminders, customer-service communications, warranty or maintenance reminders, review requests, storm-related information, and occasional marketing or promotional offers.

B. Consent

By entering your mobile number and affirmatively opting in, you authorize Helm Exteriors to send recurring informational and, where selected, marketing text messages to that number. Messages may be sent using an automatic telephone dialing system, automated technology, or an artificial or prerecorded voice where legally permitted.

Consent to marketing messages is not a condition of purchasing goods or services.

C. Frequency & Charges

Message frequency varies based on your inquiry, project activity, communication preferences, and selected programs. Message and data rates may apply. Your wireless carrier's terms and charges govern your mobile service.

D. Opt-Out

You may opt out at any time by:

  • Replying STOP to a Helm Exteriors text
  • Telling us in writing or during a telephone call that you wish to stop
  • Emailing [email protected]
  • Using another reasonable method of communicating your request

We may send one final message confirming that your opt-out request was processed. The confirmation will not contain marketing content. After opting out, you may continue to receive legally permitted non-marketing messages when necessary to complete an active transaction, perform a contract, address a safety issue, or respond to a message you initiate.

No license or ownership interest is transferred to you by using the website.

Governing Law & Venue

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles.

Unless a separate signed agreement provides otherwise, a dispute arising solely from the website or these Terms must be brought in a state court of competent jurisdiction located in Montgomery County, Texas, or the applicable federal court serving Montgomery County, Texas. You consent to the personal jurisdiction of those courts.

Disputes arising from contracted construction or exterior services are governed by the dispute provisions of the applicable signed agreement.

Informal Dispute Resolution

Before filing a lawsuit concerning the website, the complaining party is encouraged to provide written notice describing the party's name and contact information, the relevant facts, the requested resolution, and supporting documentation.

The parties should attempt in good faith to resolve the matter before formal litigation, except when emergency injunctive relief, a filing deadline, or another urgent legal remedy makes prior notice impracticable.

We may revise these Terms periodically. Revised Terms will be posted with an updated "Last Updated" date. Changes apply prospectively unless otherwise stated or permitted by law.

Continued use of the website after revised Terms become effective constitutes acceptance of the revised Terms. Changes to these website Terms do not amend a signed construction, warranty, or service agreement unless the parties separately agree in writing.

Severability

If any provision of these Terms is found invalid, illegal, or unenforceable, that provision will be enforced to the maximum extent permitted or modified as necessary, and the remaining provisions will remain in effect.

No Waiver

A failure by Helm Exteriors to enforce a provision of these Terms does not waive that provision or any other right. A waiver must be made in writing by an authorized representative of Helm Exteriors.

Entire Agreement Concerning Website Use

These Terms and the Privacy Policy constitute the complete agreement between you and Helm Exteriors concerning use of the website and online services. They do not replace or modify a separate signed proposal, construction agreement, financing agreement, warranty, work authorization, or other project-specific agreement.
